Terms of Service
The agreement between you and FairTix. Deliberately written to be read — if a term here would surprise you, we have failed.
Read this part if you read nothing else. FairTix sells tickets on behalf of event organizers. The organizer runs the event and is responsible for it. If an event is cancelled, you get your money back. Resale is capped so nobody can scalp you. Your ticket is yours to transfer.
1. What FairTix is
FairTix is a platform where event organizers sell tickets and where fans buy, transfer, and resell them. We are not the event. The organizer decides what happens at their event, sets the price, and is responsible for delivering it. We are responsible for the ticketing: that your ticket is genuine, that it works at the door, and that the money is handled correctly.
2. Your account
- You must be 18 or older to hold an account.
- Use real information. Your tickets are tied to your account, and we cannot give them to someone whose identity we cannot establish.
- Keep your password to yourself. Anything done from your account is treated as done by you.
- One person, one account. Creating extra accounts to get around ticket limits is a violation of these terms and of federal law.
3. Buying tickets
The price you see is the price you pay. FairTix shows the complete all-in total — including every mandatory fee — before you are asked to commit to anything. We do not add surprise fees at the final step.
Putting seats in your cart holds them briefly so you can finish checking out. If the hold expires, the seats go back on sale. A purchase is complete when we confirm it, not when you submit the form — occasionally a seat is taken in the seconds in between, and if that happens you are not charged for it.
Ticket limits and bots
Organizers may limit how many tickets one person can buy. Using bots, scripts, or multiple accounts to exceed those limits is prohibited. It also violates the federal Better Online Ticket Sales Act. We cancel tickets bought this way, and we do not refund the fees on them.
4. What your ticket entitles you to
A FairTix ticket is a revocable licence to attend a specific event, in a specific seat, subject to the organizer's and venue's rules. It is not property, not an investment, and not a security. It has no value beyond admission to that event, and nothing about it is offered on the basis that it will appreciate.
Every ticket clearly shows, before you buy:
- The total price, all in
- Whether it can be transferred
- Whether it can be resold, and the maximum resale price
- Any deadline after which it can no longer be transferred
5. Transfer and resale
You may give your ticket to someone else. The ticket stays yours until the recipient accepts it, so a mistyped address does not lose it. Once they accept, your entry code stops working and theirs starts — a ticket admits one person, once.
Where the organizer allows resale, you may list your ticket on FairTix up to a capped price — by default 110% of what the ticket originally cost. The cap is enforced by the system, not by policy: a listing above it is refused. You may not sell FairTix tickets anywhere else; tickets sold off-platform cannot be verified and may be cancelled.
You may not list a ticket you do not hold. Selling tickets you do not yet have — speculative ticketing — is prohibited here and unlawful in a growing number of states.
6. Refunds and cancelled events
This is covered in full in our Refund & Cancellation Policy, which is part of these terms. In short: if an event is cancelled, you get a full refund of what you paid, including fees, without having to ask.
7. Getting into the event
Your entry code refreshes every few seconds and is tied to your account. Screenshots do not work — this is deliberate, and it is what stops someone selling you a photo of a ticket they still hold. Bring a charged phone.
Admission is ultimately the venue's decision. They may refuse entry for their own reasons — capacity, conduct, age restrictions, or the law. If you are refused entry for something that is our fault or the organizer's, you are entitled to a refund.
8. For organizers
If you sell tickets through FairTix, you agree that:
- You have the right to sell tickets to the event, and the event is real.
- You are responsible for delivering the event as advertised, and for refunds if you cancel it.
- You will honor every ticket FairTix issues on your behalf, including ones that were transferred or resold within your own rules.
- Attendee information is provided to you for running your event. You may not sell it, and you may not use it for unrelated marketing without the attendee's consent.
- You will comply with the law that applies to your event, including accessibility, capacity, and age restrictions.
9. Things you may not do
- Use bots, scrapers, or automation to buy tickets
- Create multiple accounts to evade limits
- Resell above the cap, or off-platform
- List tickets you do not hold
- Interfere with, probe, or attack the service
- Use FairTix to defraud anyone
We may suspend or close accounts that do these things, and cancel tickets obtained through them.
10. Our responsibility, and its limits
We take responsibility for FairTix working: that a ticket you bought is genuine, that it admits you, and that your money is handled correctly. If we get that wrong, we will make it right.
We are not responsible for the event itself — its quality, its content, its lineup, or an organizer's conduct — and we are not responsible for things outside our control, such as weather, venue closures, or a performer cancelling. Except where the law does not allow us to limit it, our total liability to you for any claim is capped at what you paid us for the tickets involved.
Nothing in these terms takes away rights you have under consumer protection law that cannot be waived.
11. Disputes
Write to support@fairtixnow.com first — nearly everything is resolved that way, quickly. These terms are governed by the laws of the State of Texas, and any dispute that cannot be resolved directly will be handled by the courts located in Travis County, Texas.
12. Changes
We may update these terms. If a change materially affects you, we will tell you before it takes effect. Changes never apply retroactively to tickets you have already bought — the rules that were shown to you at purchase are the rules that govern that ticket.
